(Trades & Services Staff - Catering & Retail, Cleaning & Caretaking, & Miscellaneous Services Staff) 2000

Part 3 - Conditions applying to catering and retail staff

Section 4 - Gippsland Campus Catering Staff Only

  1. Gippsland Campus Catering Staff Part-time Loadings
  2. Temporary Closedown and Annual Leave for Gippsland Campus Catering Staff

This Part shall apply to all trades and services staff engaged in catering and/or retail services (including Tea Attendants) but does not extend to Sports Control Desk staff employed within the Sports and Recreation Centre on Clayton Campus.

80. GIPPSLAND CAMPUS CATERING STAFF PART-TIME LOADINGS

Part-time catering staff members on the University's Gippsland Campus are entitled to payment of a part-time loading of 10% of the staff member's ordinary rate of pay. Provided that this clause shall have no application to any staff engaged in seasonal employment under either clause 95 or 101 of this Agreement, and the part-time loading shall not be payable in addition to the rates prescribed for work performed on weekends, holidays, or overtime where the rates prescribed are double time or double time and a half.

81. TEMPORARY CLOSEDOWN AND ANNUAL LEAVE FOR GIPPSLAND CAMPUS CATERING STAFF

Where the University intends temporarily to close (or reduce to nucleus) a section for the purposes (inter alia) of allowing annual leave to the staff members concerned or a majority of them, the University may give in writing to such staff members one month's notice (or, in the case of any staff member engaged after giving of such notice, notice on the date of the staff member's engagement) of intention to apply the provisions of this clause and thereupon:

  • Any staff member who at the date of closing is entitled to annual leave shall be given such annual leave commencing as on and from the date of closing and, in addition, shall be paid one-twelfth of the ordinary rate of pay for any period of employment after accrual of the staff member's right to annual leave and up to but excluding the date of closing;
  • Any such staff member who at the date of closing is not entitled to annual leave shall be given leave without pay as on and from the date of closing and shall be paid one-twelfth of the ordinary rate of pay for the period since the commencement thereof or the accrual of the staff member's last annual leave (whichever is the later) and up to but excluding the date of closing, together with pay for any holiday occurring during such leave for which the employee is entitled to payment under this Agreement; and
  • The next twelve-monthly qualifying period of employment for every such staff member shall commence on and from the date of closing.

For the purposes of this clause, "date of closing" in relation to each staff member means the first day of the staff member's annual leave pursuant to this clause.
