This Part shall apply to all trades and services staff engaged in catering and/or retail services (including Tea Attendants) but does not extend to Sports Control Desk staff employed within the Sports and Recreation Centre on Clayton Campus.
95. SEASONAL EMPLOYMENT FOR MONASH UNICOMM CATERING STAFF AND MONASH UNICOMM RETAIL SERVICES STAFF
95.1 A "seasonal worker" shall be defined as a staff member whose terms of engagement are variable in accordance with the seasonal work requirements of Monash Unicomm. Seasonal workers shall receive a loading equivalent to 8% of the ordinary rate of pay for their classification, except where a higher penalty rate or loading is prescribed herein.
Provided that seasonal workers first employed with Monash Unicomm after 25 November 1997 shall receive a loading equivalent to 4% of the ordinary rate of pay for their classification except where a higher penalty rate or loading is prescribed for overtime, work on University holidays, or the payment of annual leave loading.
95.2 Seasonal workers first employed after 25 November 1997 shall not be entitled to any loadings provided under clause 95.1 for the following public holidays: Good Friday, Easter Monday and Easter Tuesday, except where those days are worked by the staff member in which case the applicable penalty rate shall apply.
95.3 Periods or roster cycles during which a seasonal worker is not engaged will not count as service, but neither will they act to interrupt the continuity of service.
95.4 Within a period of three months after the certification of this Agreement, each existing casual retail services staff member of Monash Unicomm shall have the option of transferring to seasonal employment in accordance with the provisions of this clause. Those staff who elect not to transfer to seasonal employment shall remain as casual staff employed subject to the provisions of this Agreement.
95.5 In addition to Parts 4 and 5 of this Agreement, the following clauses shall have no application to seasonal Monash Unicomm catering staff or seasonal Monash Unicomm retail services staff:

96. ROSTERS FOR SEASONAL MONASH UNICOMM CATERING STAFF AND SEASONAL MONASH UNICOMM RETAIL SERVICES STAFF
96.1 All seasonal work will be rostered for a period of not less than two weeks. During the currency of the roster, working arrangements will only be varied where agreement is reached between the staff member and management. A "roster" includes work performed on Monday - Friday, but excludes any work performed on Saturday and Sunday
96.2 If a function, scheduled outside term time, is cancelled due to circumstances outside the control of management, staff members rostered to work at that function may have their rosters reduced accordingly, provided that affected staff members will be notified at the earliest possible opportunity. A staff member reporting for work as a result of not having been notified will be paid as for a minimum engagement.
96.3 New rosters will be posted at least one week prior to the end of the current roster.
96.4 A seasonal staff member will be rostered for a minimum of three hours on any single engagement, except for students of the University who may be rostered for one hour engagements, provided a minimum of three are rostered during any pay period and provided further that the student is already on campus.
96.5 There will be no minimum number of engagements per week and the number of engagements may vary between rosters.
96.6 When seasonal work variations are such that the seasonal staff member is not required for the time set down in the roster, he/she will be advised at least one week prior to the next roster on which he/she will be required.
97. OVERTIME RATES FOR SEASONAL MONASH UNICOMM CATERING STAFF AND SEASONAL MONASH UNICOMM RETAIL SERVICES STAFF
97.1 A seasonal staff member may be offered additional hours during the period of a roster (ie. Monday - Friday). Such work will be paid at the normal seasonal work rate provided it does not lead to a seasonal staff member exceeding 76 hours during the currency of any roster. Work performed in excess of 76 hours during the currency of any roster shall attract the appropriate overtime rate as provided in clause 97.2 below.
97.2 Overtime worked from Monday to Friday will be paid at the rate of time-and-a-half for the first three hours, double-time thereafter.
98. MULTI-HIRE ARRANGEMENTS FOR SEASONAL MONASH UNICOMM CATERING STAFF AND SEASONAL MONASH UNICOMM RETAIL SERVICES STAFF
All seasonal Monash Unicomm catering staff may elect to earn extra income by being engaged under multi-hire arrangements to work on Saturdays or Sundays, but only where the salary rate for the staff member's seasonal appointment exceeds that of the multi-hire engagement.
The following penalty rates based on the salary rate for the staff member's seasonal appointment will be paid for multi-hire work performed:
- Saturday - time and a quarter for all hours worked; and
- Sunday - time and a half for all hours worked.
Multi-hire work performed will count as ordinary hours provided that where the staff member's aggregate ordinary hours exceed 76 hours per fortnight and the multi-hire work is performed during that fortnight then any time worked beyond 76 hours will be paid as overtime. Provided further that when the time worked in excess of 76 hours per fortnight is multi-hire work, then overtime will be paid in accordance with either the prescribed overtime rate or the multi-hire engagement rate, whichever is the greater.
99. SEASONAL MONASH UNICOMM CATERING STAFF AND SEASONAL MONASH UNICOMM RETAIL SERVICES STAFF LEAVE ENTITLEMENTS
99.1 Seasonal staff members will be entitled to annual leave and such leave will accumulate at the rate of one-twelfth of ordinary time worked. The annual leave loading of 17.5% will be payable in lieu of the relevant seasonal loading prescribed in clause 95.
In addition but subject to clause 42.10, seasonal staff members shall have the option each year of taking payment in lieu of accrued annual leave on the pay day of the first full pay period in November each year.
99.2 Seasonal staff will be entitled to sick leave and such leave will accumulate one-twentieth of ordinary time worked during the first year of service, and one-sixteenth of ordinary time worked each year thereafter. Sick leave taken will be paid at the following rates:
- ordinary rate of pay plus 8% seasonal loading for staff employed prior to or on 25 November 1997; or
- ordinary rate of pay exclusive of any loadings for staff first employed after 25 November 1997.
99.3 Seasonal staff will be entitled to long service leave provided that payment shall be at the staff member's ordinary rate of pay excluding any loadings. |
