University entrance and admission to courses regulations
Regulations made pursuant to Statute 6.1.1 - University
entrance and admission to courses
1. In these regulations, unless inconsistent with the context
or subject matter -
'approved' means approved by the relevant committee or body of the university;
'deputy vice-chancellor' means the deputy vice-chancellor and vice-president
responsible for the academic administration of the university;
'units' means VCE units taken at levels one and two or three and four,
as the case requires;
'VCE' means Victorian Certificate of Education.
2. For the purposes of
Statute 6.1.1 - University entrance and admission to
courses the entrance
requirements of the university are:
2.1.1 satisfactory completion of the VCE, including units 3 and 4 of
English at an approved level; or
2.2 an approved equivalent
3.1 A faculty board may, with the approval of the Academic Board, determine
the requirements for admission to any course of study prescribed for a
degree or diploma in the faculty.
3.2 A faculty board must cause any determination under subsection 3.1 to
be published in the admission to courses handbook of the university.
3.3 A person satisfies the admission requirements for any particular course
of study prescribed for a degree or diploma in a faculty if he or she satisfies
the relevant requirements set out in the admission to courses handbook.
4. Two
requirements of the university’s special admission scheme
are -
4.1.1 satisfactory completion of two units in a course of study in an Australian
university or via Open Universities Australia; and
4.1.2 satisfactory completion of an aptitude test approved by the Academic
Board.

6. A person who has at any time been enrolled for a course of study or
unit at the university and has:
6.1 lodged a notice of discontinuance of studies;
6.2 been certified by the deputy vice-chancellor as having discontinued
or withdrawn from studies; or
6.3 not re-enrolled within the time specified by the deputy vice-chancellor
-
but who is otherwise entitled to re-enrol, shall be entitled to re-enrol
only with the permission of the dean of the faculty concerned.

8.1 Subject to the Higher
Education Funding Act 1988 (Cwth), the vice-chancellor
must from time to time set application and tuition fees in accordance with
principles and within ranges determined by the Council, provided that,
in circumstances the vice-chancellor deems exceptional, a fee may be set
within 10 per cent either side of a range so determined.
8.2 The person liable to pay a fee is -
8.2.1 in the case of an application fee, the person who makes the application;
and
8.2.2 in the case of a tuition fee, the person to whom the tuition is being
or will be given.
8.3 A fee payable by a person is payable -
8.3.1 in the case of an application fee by the date notified in writing
by the university to the person as the due date; and
8.3.2 in the case of any other fee by the date the person enrols or re-enrols
at the university, or by the date notified in writing by the university
as the due date whichever last occurs.
8.4 A fine not exceeding twenty-five per centum of a fee may be imposed
by the vice-chancellor if a fee is not paid by the due date.
8.5 While a fee remains unpaid the person liable to pay the fee may not
obtain a transcript of or other document relating to his or her academic
record or be awarded a degree, diploma or certificate.
8.5A Despite subsection 8.5, a person may obtain a transcript of or other
document relating to his or her academic record in respect of any period
of study for which a fee was payable and paid.
8.6 Subject to sections 8.7 and 8.9, any enrolment or re-enrolment of a
person who is liable to pay but does not pay a fee by the due date, is
by force of these regulations invalidated.
8.7 An enrolment or re-enrolment is not invalidated pursuant to section
8.6 if the enrolment or re-enrolment is not effected owing to any deliberate
action or omission by the person who is enrolled or re-enrolled, or is
effected solely because of a university error.
8.8 Subject to section 8.13 a fee which is unpaid after the due date is
a debt due and owing to the university by the person who is liable to pay
the fee, and the university may initiate recovery action -
8.8.1 if the fee is unpaid owing to a university error, at any time prior
to the expiration of twelve (12) months after the due date; and
8.8.2 in any other case at any time prior to the expiration of six (6)
years after the due date.
8.9 If the vice-chancellor considers that exceptional circumstances apply,
the vice-chancellor may waive, defer or mitigate payment of a fee.
8.10 The vice-chancellor may determine in relation to a deferred or mitigated
fee any condition regarding payment including the due date.
8.11 A determination under section 8.10 shall be notified in writing to
the person liable to pay the fee, and in the case of a determination of
the due date, that date is the date notified for the purposes of section
8.3.
8.12 If the vice-chancellor waives the payment of a fee by a person, that
person is deemed to have paid the fee for the purposes of these regulations.
8.13 If payment by a person of a fee is determined under section 8.10 to
be made by instalments and the person defaults in paying an instalment
by the date it must be paid, that date is deemed to be the due date for
the purposes of sections 8.6 and 8.8.2.
8.14 Where a person is given permission by a dean to re-enrol pursuant
to section 6, any fee paid by that person prior to any payment of a fee
payable for re-enrolment shall with the permission of the dean be credited
against that or any further fee payable in respect of a course of study,
subject or unit of a subject as the case may be.
8.15 A reference to a fee in this section -
8.15.1 is a reference to a fee set by the vice-chancellor under section
8.1; and
8.15.2 in sections 8.3, 8.4, 8.5, 8.6, 8.8, 8.11, 8.13 and 8.14 includes
a reference to any part of a fee and a mitigated fee as the case requires.
8.16 In this section 'tuition fee' means a fee which is charged by the
university for one or more of selection, materials, teaching, examination,
any work-related excursions or assignments or any other matter in respect
of an award course of study, or unit in an award course of study undertaken
or to be undertaken by a person.
8.17 Notwithstanding that a tuition fee is charged to a person in respect
of a course of study pursuant to an agreement between the university and
the person, another tuition fee may be charged during the course of study
to the person if the matter for which the other fee is charged is certified
by the dean of the relevant faculty to be a necessary and not normal requirement
of the course of study, or not contemplated at the time the tuition fee
was set.
8.18 A reference to the due date in this section is a reference to the
date by which a fee is payable.
8.19 The vice-chancellor may set fees for non-award short courses or not-for-credit
participation in award courses.
8.20 Sections 8.3.2 to 8.14 inclusive, section 8.15.2 and section 8.18
shall apply to a fee referred to section 8.19 as if a reference to a fee
in those provisions were a reference to a fee referred in section 8.19
respectively.
