Chapter 8 - Seal of the university
Statute 8.1 - The seal of the university
1.1 The seal of the university shall be in the custody of the deputy
vice-chancellor and vice-president responsible for university-wide resource
management or nominee.
1.2 The seal shall not be affixed and the affixing of the seal shall
not be attested or counter-attested except as provided by this statute.
2.1 The seal shall be affixed to -
2.1.1 a certificate to be issued in respect of any degree diploma
or other award conferred by Council;
2.1.2 a statute;
2.1.3 to a verified copy of a statute or regulation required for
production in any court or before any person acting judicially;
2.1.4 any document in respect of which Council directs the seal
is to be affixed;
2.1.5 any other document in respect of which the chancellor, a
deputy chancellor or the vice-chancellor and president directs
the seal is to be affixed if, in the opinion of the person giving
the direction, the document involves a matter which is formal only
or of special urgency.
3. The seal may be affixed to any document by a person authorised
by Council and -
3.1.1 in the case of a certificate referred to in section
2.1.1 may also be affixed by the divisional director (student and
staff services) or nominee; and
3.1.2 in the case of any document other than a certificate referred
to in section 2.1.1 may also be affixed by the university solicitor
or nominee.
4.1 Except in the case of a certificate referred to in section
2.1.1 or a verified copy referred to in paragraph 2.1.3 the form
to be used in affixing the seal shall be -
'THE COMMON SEAL of MONASH UNIVERSITY was hereto affixed on the
.......................... day of .......................... by
direction of [the Council, the chancellor, a deputy chancellor
or the vice-chancellor and president, as the case requires] in
the presence of .....................................................'
or to the like effect.
4.2 In the case of a statute, the affixing of the seal is deemed
to be by direction of Council.
5. The affixing of the seal -
5.1.1 in the case of a certificate referred to in section 2.1.1, shall be attested by the chancellor or a deputy chancellor and counter-attested by the vice-chancellor and president or a deputy vice-chancellor and vice-president; and
5.1.2 in the case of a document other than a certificate
referred to in section 2.1.1, shall be attested by the chancellor, a deputy
chancellor or the vice-chancellor and president, and counter-attested by
a deputy vice-chancellor and vice-president or by any other person approved
by resolution of Council.
6. Where the seal is affixed to a document in accordance with
section 2.1.5, the matter shall be reported to Council by the vice-chancellor
and president as soon as practicable after the document is attested
and counter-attested.
