Throughout 2017, the Faculty of Law, in conjunction with the Supreme Court of Victoria, Victorian Bar, Commercial Bar, Law Institute of Victoria and Judicial College of Victoria, will hold seminars covering current commercial law topics. The seminars will be of interest to the legal fraternity, students and the general public.

Abuse of Process

All courts have jurisdiction to prevent their processes from being used as an instrument of oppression or otherwise misused.  In the same vein, practitioners are obliged to refrain from bringing proceedings or conducting litigation where to do so would amount to an abuse of process.

While a decisive response to frivolous and improper claims is vital to minimising the expense and distraction that they can cause, the most obvious response is not always the best strategic solution.  Similar considerations come into play when responding to inappropriate applications and other steps taken in the conduct of otherwise appropriate claims.
