Module 2: General techniques used in court

MODULE 2 GENERAL TECHNIQUES USED IN COURT presents the general techniques used by Magistrate Fanning that are transferable to a traditional Magistrates' Court courtroom. The techniques include communication techniques with the person appearing before the court and engaging with treatment and service providers or other professionals appearing in court. These techniques are aimed at improving the court experience, using effective communication skills and ultimately increasing compliance with court orders. Highlights of Module 2 include a video of Magistrate Fanning discussing these techniques with a panel of other magistrates who sit in mainstream Magistrates' Courts. More detailed written information is provided in the Background Materials. There is also a Tip Sheet for quick reference.

Many of the techniques discussed in Module 2 are also discussed in 'Judicial Orientation and Self-Represented Litigant' workshops conducted by Professor Tania Sourdin, Foundational Director of ACJ, on behalf of the Judicial College of Victoria. This and the other Modules are intended to support the Judicial College of Victoria resources and provide judicial officers with another opportunity to consider interactions with people appearing before the court and when engaging with treatment and service providers.

In this video, Magistrate Fanning and the panel of magistrates discuss a number of communication techniques used when communicating with people appearing before the court. These techniques are grounded in principles of procedural fairness and therapeutic jurisprudence and are aimed at improving engagement with the person appearing before the court, increasing compliance with court orders and assisting people to address the underlying causes of offending. Topics discussed in this video are:

  1. Communicating directly with the person appearing before the court
  2. Explaining court orders and court processes
  3. Using a less formal approach in court.
