Module 3: Sentencing Approaches

MODULE 3 SENTENCING APPROACHES outlines approaches used at the NJC in the sentencing phase. Topics covered in the videos and the Background Materials include techniques in obtaining an undertaking from the person appearing before the court in the pre-sentence period, the use of deferred sentencing and sentencing. The use of a community correction order (CCO) to achieve therapeutic or rehabilitative goals is discussed. There is also a Tip Sheet for quick reference.

In this video, Magistrate David Fanning discusses the use of deferred sentences. Deferred sentences are used in approximately 30 percent of cases that come before the NJC and are a useful tool to enable the person appearing before the court to take steps to address the causes of their offending and for the judicial officer to monitor their progress prior to sentence.
