Bringing Commercial Law to Life Through International M&A

For Juris Doctor candidate James Damches, one unit has stood out as a defining experience in his Monash Law journey: LAW5473 International Mergers & Acquisitions, taught by academic and lawyer Adjunct Associate Professor Tim Bowley.
James described the unit as, “the highlight of my Juris Doctor to date,” an experience that deepened his passion for commercial law and strengthened his understanding of the role lawyers play in shaping major commercial transactions.
“It certainly helps when students are passionate about commercial law and can appreciate its real-world implications. However, this class elevated the experience by inviting partners and highly experienced practitioners from leading firms to speak with us about the realities of practising M&A in Australia. Hearing directly from those at the forefront of major transactions provided invaluable practical insight that complemented the academic material.”

“It has been by far the most enjoyable subject I have undertaken.”
James also points to Monash’s distinctive approach to commercial law as a major strength.
"Monash University stands out as one of the few law schools in Australia that places such a strong emphasis on commercial law without sacrificing practical relevance," he said.
"The course content is highly aligned with the realities of contemporary legal practice, and it demonstrates how commercial lawyers play a central role in facilitating complex transactions that shape the economy."
This alignment between theory and practice reflects the work of the Centre for Commercial Law and Regulatory Studies (CLARS), a hub James views as central to Monash’s leadership in the field.
“Through the Centre for Commercial Law and Regulatory Studies (CLARS), Monash is arguably the leading institution for the study of commercial law in Australia,” he said.
“The Centre strikes an impressive balance between academic rigour and practical engagement, ensuring that graduates are equipped with the analytical and professional skills required to contribute meaningfully to major commercial transactions.”
James also speaks warmly of Dr Bowley’s teaching style and commitment to student learning.
“Tim is both approachable and inspiring. Together with the other academics involved in CLARS, he has created a genuinely engaging and intellectually stimulating learning environment by discussing major cases such as the mighty tech giants in the United States, highly relatable in the modern context.”
This dynamic, contemporary approach helped reinforce James’ interest in pursuing a career in commercial law - an impact that will continue well beyond the classroom. He hopes to maintain connections with Dr Bowley and the academics working in this area as his career develops.
