Procedural Fairness and (Legal) Regulation - Getting the Balance Right

Caroline Morgan

Why is your research important?

The key issue is how to get the balance right between individual rights to fairness as against other regulatory objectives, such as efficiency, effectiveness and consumer protection. This is important to discussions about the workability of procedural fairness in a regulatory context; the expanding doctrine of procedural fairness, and questions about who should be heard and participate in regulatory processes; and how to assess and determine an appropriate balance.
