Terms and Conditions

In these terms and conditions (Terms), “Monash University”, “us”, “we” and “our” means Monash University (ABN 12 377 614 012). We operate and maintain the:

(a)           Monash University Parking Application known as UbiPark (the “MU Parking Application”);

(b)           MU Parking website accessible at monashuni.ubipark.com (Website) as outlined further in section 2.1; and

(c)           services provided through the Application and Website, including STRIPE and MU Parking as outlined further in section 2.1, (together the Monash University Services).

Privacy Policy

Your personal information will be handled in accordance with the Monash Parking T&Cs and Monash Parking App T&Cs and the relevant Monash Collection Statement. For more information about Data Protection and Privacy at Monash University please see our Data Protection and Privacy Procedure. If you have any questions about how Monash University is collecting and handling your personal information, please contact our Data Protection and Privacy Office at dataprotectionofficer@monash.edu.

Terms of Use

1. TERMS OF USE

1.1       It is strictly prohibited to use the Monash University Services, including the MU Parking Application, in any way whatsoever while you are driving a vehicle and/or in any way that may interfere with your attention to driving or the road conditions. Any information provided in or via the Monash University Application does not and is not intended to replace any information regarding traffic conditions or laws relating to traffic, road safety and the use of smartphones or other Internet-enabled devices while driving.

1.2       The Monash University Services are available for you to download, access and use provided that you accept these Terms. By downloading or continuing to access or use the Monash University Services you are agreeing to be bound by these Terms. If you do not agree to these Terms, you must not download, access or use the Monash University Services.

1.3    You acknowledge and agree that:

  • (a)     the access and use of the Monash University Services is entirely at your own risk. You are responsible for all activity in connection with your access to and use of the Monash University Services;
  • (b)     any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities; and
  • (c)      we may amend, move or remove, or add to, any or all of the Monash University Services from time to time, at our discretion, without prior notice or liability to you.

1.4    You may not use the Monash University Services:

  • (a)     for any activities that breach any laws including any laws relating to traffic, road safety and the use of a smartphone or other internet enabled device whilst driving, infringe any party’s rights or breach any standards, content requirements or codes of any government authority;
  • (b)     in any manner that may circumvent, damage, disable, overburden, or impair the Monash University Services or interfere with any other party’s access, use and enjoyment of the Monash University Services;
  • (c)     to distribute any virus, harmful components or other disabling computer code in any form;
  • (d)     to distribute any explicit, sexual, vulgar, offensive, obscene, profane or inappropriate imagery or communication, as determined by Monash University in its absolute discretion;
  • (e)     in any manner which is or is likely to be invasive of a person’s privacy, could constitute harassment, or cause distress or inconvenience to any person;
  • (f)      to make unauthorised access or modifications to the Monash University Services;
  • (g)     to obtain unauthorised or fraudulent access to any parking service featured on the MU Parking Application operated by any third-party parking operator (Operator);
  • (h)    to advertise or perform any commercial or other form of solicitation that is not authorised by us; and/or
  • (i)      in any manner or for any purpose which is contrary to these Terms.

1.5    Monash University reserves the right to amend these Terms from time to time. Your use of the Monash University Services following any amendment constitutes your agreement to the Terms as amended.

2. SCOPE OF SUPPLY AND USER REGISTRATION

2.1    The scope of supply of the Monash University Services is as follows:

Website: The purpose of the Website is to provide you with information about, and links to access, the  Monash University Services including through the  Monash University Customer Console.

Application: The MU Parking Application is a consolidated parking platform enabling you to locate, compare, navigate, book, facilitate access to and make payment for any parking service featured on the MU Parking Application operated by any Operator via a smartphone application.

The following services are provided through the MU Parking Application:

  • (a)     platform to search for and view information about any parking services which are featured on the MU Parking Application;
  • (b)     booking and paying for parking services (STRIPE); and
  • (c)     entering and exiting parking spaces using the MU Parking Application.

2.2    To access MU Parking Application as a Monash University user, you must sign in as a user of the MU Parking Application by:

  • (a)     signing in with the Okta option;
  • (b)     providing details of a valid payment method to enable to us deduct payments from you (for example, by providing us with details of a valid credit card), unless you use the salary sacrifice payment method option

2.3    To access the MU Parking Application as a visitor , you must register as a user of the MU Parking Application  by providing us with:

  • (a)     your full name and email address OR access to your Microsoft personal account, Gmail account, Facebook account or Apple account if you are a pre-registered hybrid account user;
  • (b)     your phone number; and
  • (c)     details of a valid payment method to enable to us deduct payments from you (for example, by providing us with details of a valid credit card)

User Information

If you do not provide accurate and complete details, we may not be able to register you as a User or provide the Monash University Services to you.

2.4    You may use the MU Parking Application without providing us with your User Information. However, if you do not provide us with your User Information, you will not be able to access certain Monash University Services including STRIPE and the MU Parking Application. Even if you do not provide us with your User Information, we will still have access to certain information associated with your use of the MU Parking Application. This information will be collected in accordance with our Privacy Policy.

2.5    Monash University may refuse your registration as a User at its discretion without liability to you.

2.6    The contract for the supply of any parking service that you book, access and pay for through the Monash University Services is between you and that Operator and is governed by that Operator’s terms and conditions. You must comply with that Operator’s terms and conditions for the relevant parking site. The Monash University Services are the only services we provide to you and we do not provide you with any parking services whatsoever.

2.7   In order to use STRIPE and the MU Parking Application, you must have a smartphone with internet access and be registered and logged in as a User, at the times you enter and exit the parking service.

2.8   The MU Parking Application is not and must not be taken as our recommendation or endorsement of the quality, service level, value for money or suitability of any parking service or Operator located, booked, accessed or paid for via the Monash University Services.

3. FEES AND PAYMENTS

3.1    If you use STRIPE and the MU Parking Application, we will charge the applicable fees payable to an Operator (Fees) for the relevant parking service that you use directly to the credit card nominated in your User Information. Monash University will facilitate your payment of the Fees on behalf of the Operator as the Operator’s limited payment collection agent.

3.2    Monash University utilises a payment gateway based in Australia to process all payments.

3.3    You agree and acknowledge that we will treat any electronic instruction as authentic and that we are under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions. If your nominated payment method triggers our internal suspect transaction protocols, we may contact you to confirm additional details, or rescind the transaction

3.4    If you use STRIPE and the MU Parking Application on a casual basis, the Fees will be automatically calculated by electronic means. We utilise proprietary integrated software and hardware to determine the time you enter and exit an Operator’s parking service and calculate the Fees accordingly. While we endeavour to charge the Fees at the time of using the Operator’s parking service, it may take up to five (5) business days for your credit card to be charged. We reserve the right to finalise the transaction and any applicable Fees manually if reasonably required.

3.5    While Monash University uses its best efforts to provide you with accurate information regarding the estimated Fees payable to an Operator for any parking service, you acknowledge and agree that all such information is controlled by the relevant Operator and not Monash University. To the maximum extent permitted by law, we exclude all liability and warranties relating in any way to information about Fees or the amount of the Fees actually charged to your credit card.

3.6    If you misuse STRIPE, the MU Parking Application or the Monash University Services in any material manner, we reserve the right to obtain payment of the Fees and any other amount reasonably required to compensate Monash University for its actual loss, costs or expenses in the circumstances.

3.7    An internet connection is required to use the Monash University Services. Any fees and charges associated with establishing an internet connection to use the Monash University Services are entirely your responsibility and shall be entirely at your own expense.

4. REFUNDS

4.1    28-day permits are non-refundable. Refund requests for any other type of parking session must be submitted via email to: buildings.property@monash.edu. for processing.

4.2    Refund requests will be assessed on a case by case basis and a refund, whether full or partial, will only be applied for a system error resulting in an incorrect charge.

4.3    Monash University and the relevant Operator, acting reasonably, reserve the right to refuse a refund for any Fees deducted from your Monash University account when deducted in accordance with these terms and conditions.

4.4    Once a refund has been approved and processed, an email confirmation specifying the refund amount and relevant transaction details will be sent to the email registered to your Monash University account. Refunds may take up to 14 days to be completed and reflected in your bank account.

5. INTELLECTUAL PROPERTY RIGHTS

5.1    All content on the Monash University Services, including graphics, logos, trade marks, moral rights, text, systems, designs, source code, material or software, is protected by Australian and international copyright and trade mark law. Unless otherwise indicated, Monash University owns or is licensed to use all intellectual property (including patents, copyright, trade marks and designs) subsisting in the content on the Monash University Services.

5.2    We grant to you a non-exclusive, non-transferable, and revocable licence to use the intellectual property rights in relation to the Monash University Services for the limited, non-commercial purpose of allowing you to access, use and enjoy the Monash University Services in accordance with these Terms.

5.3    You must not, without our prior written consent:

  • (a)     re-sell, offer to rent or lease the Monash University Services or any part thereof;
  • (b)     modify, adapt, translate, reverse engineer, decompile, decode, disassemble, create derivative works or in any way derive or discover source code from the Monash University Services or any part thereof;
  • (c)     integrate the Monash University Services or any part thereof within a good or service of your own;
  • (d)     reproduce, republish, upload to a third party, repost, transmit, distribute, sub-licence, assign, share, rent, lease or otherwise transfer or grant any rights in the Monash University Services or part thereof, in any way.

6. PRIVACY POLICY

6.1    Monash University values the privacy of its Users and makes all commercially reasonable efforts to protect it. Monash University Privacy Policy forms part of these Terms and covers the collection, use and disclosure of personal information that may be collected any time you interact with Monash University, such as when you use the Monash University Services or communicate with Monash University representatives and employees.

6.2    To learn more about what information Monash University collects, what we do with that information, and how we may use your personal information, please read our Privacy Policy located at [URL].

7. WARRANTIES

7.1    By using the Monash University Services, you warrant that:

  • (a)     you are at least 16 years of age, or otherwise of legal age to be operating a motorised vehicle, in accordance with the law in the relevant country, state or territory;
  • (b)     you are capable of entering into legally binding contract with Monash University, and into a separate legally binding contract with any Operator;
  • (c)     you are authorised and able to make payment via any credit or debit card you have provided details for in the Application;
  • (d)     the credit or debit card the details for which you provided is valid; and
  • (e)     the User Information that you provide to Monash University in the Application is accurate and current, and that you will keep your User Information up to date at all times.

7.2    We will use our best efforts to provide you with the Monash University Services, however the Monash University Services are provided on an 'as is' basis only. To the maximum extent permitted by law, Monash University excludes all warranties whether express, implied, statutory or otherwise relating in any way to the Monash University Services, and/or any other subject matter of these Terms. Nothing in this clause restricts or modifies any right or remedy you may have under the Australian Consumer Law.

8. LIMITATION OF LIABILITY

8.1    You acknowledge and agree that:

  • (a)        your use of the Monash University Services is entirely at your own risk;
  • (b)        we are not responsible or liable for any loss or damage as a result of any use of the Monash University Services by you;
  • (c)         we do not provide any parking services and we are not liable to you for any loss or damage arising from your use or inability to use any parking services;
  • (d)        we are not liable to you for:
    • (i)          any inaccuracies in or changes to the Monash University Services, including the location of, availability of, fees payable to or the terms and conditions that apply, in respect of any parking service;
    • (ii)        any interruptions to, delays or inability to access the Monash University Services caused by any act, mission or default of a third-party service provider who provides goods or services for use in connection with the Monash University Services;
    • (iii)       any direct, indirect or consequential loss or special damage whatsoever incurred or suffered by you or any third party under or in relation to the Monash University Services and/or any matter under these Terms (or our Privacy Policy) including, without limitation, under or in relation to:
      • (A)        any infringement of intellectual property rights and rights of any third party in any way connected with the Monash University Services;
      • (B)        any collection, use and disclosure of your personal information or User Information or any data breach in relation to such information;
      • (C)        any use or non-use by you of any parking service or engagement with any Operator by you; and/or
      • (D)        any use of or engagement with any Third Party Content by you; and/or
      • (E)        any failure to comply with any of our obligations under these Terms if any event beyond our reasonable control occurs which prevents us from performing those obligations;
  • (d)       your sole remedy for any breach of these Terms is termination of these Terms and all other liability is expressly excluded;
  • (e)       any challenge, dispute or cause of action you may have with respect to any booking made through, or any other use of, the Monash University Services may only be commenced within the 6 month period after the relevant booking is made or use of the Monash University Services occurs; and
  • (h)        to the maximum extent permitted by law you release and discharge us and our personnel, contractors and representatives from all claims and demands on us by you or any third party and any loss or damage whatsoever and whenever caused to you, arising directly or indirectly from, or incidental to, your use of the Monash University Services except to the extent that the liability, loss, cost, expense, claim, demand, judgment or action was caused by a wilful or negligent act or omission of Monash University or any of its officers, servants or agents.

9. THIRD PARTY CONTENT

9.1    The Monash University Services may contain information and materials from third parties, including links to other websites, which are not under our control (Third Party Content). In relation to any Third Party Content featured in the Monash University Services, we:

  • (a)         do not endorse, sponsor, verify or check any Third Party Content whatsoever, unless expressly stated otherwise;
  • (b)         do not have any association with the operators of the Third Party Content, unless expressly stated otherwise; and
  • (c)          are not responsible for the material contained in the Third Party Content, including without limitation, any material or link contained in the Third Party Content, or any changes or updates to the Third Party Content.

10. INDEMNITY

10.1  You agree to indemnify Monash University (and our officers, directors, employers or contractors) against:

  • (a)         any claim made against or suffered by Monash University in connection with your use of the Monash University Services;
  • (b)         your breach of these Terms (or our Privacy Policy); and
  • (c)          your breach of any rights of third parties resulting or arising from your access or use of the Monash University Services;

except to the extent that the liability, loss, cost, expense, claim, demand, judgment or action was caused by a wilful or negligent act or omission of Monash University or any of its officers, servants or agents.

11. COMPLAINTS AND DISPUTES

11.1  Any complaints or disputes regarding any parking service provided by any Operator located, booked and paid for through the Monash University Services is between you and the Operator. We are not responsible for any complaints or communications between you and the Operator and have no liability in respect of any such dealings whatsoever.

11.2  If you have any concerns or complaints about the Monash University Services, please contact us by e-mail at buildings.property@monash.edu.

12. TERMINATION

12.1  We may terminate or restrict your access to and use of the Monash University Services at any time without giving reasons. We are not liable to you for any costs, losses or damages of any kind arising from or as a consequence of terminating your access to and use of the Monash University Services.

12.2  You may terminate your use and access to the Monash University Services at any time.

12.3  For our payment vendor (STRIPE), if you terminate your use and access to the Monash University Services before the expiry of the relevant month, you will not be entitled to any refund of any Fees paid. However, you may continue to use the parking service in respect of which you have paid until the last day of the relevant month.

12.4  If you wish for us to delete your User registration and your User Information that we hold about you, you must contact us by email at buildings.property@monash.edu. Please note that while we will use reasonable efforts to delete or de-identify your User Information, some information may be retained, including:

  • (a)         in our back-ups;
  • (b)         in accordance with our Privacy Policy;
  • (c)          for legitimate business purposes, including in order for us to comply with our legal, tax and audit requirements with such information normally accessible by the management teams of Monash University or an Operator; and
  • (d)         where it is reasonable in the circumstances for us to retain the information.

13. LINKING

13.1  You may not link to the Website or the MU Parking Application unless you have obtained prior written consent from us (which we may withhold at our discretion). If such consent is obtained you may only link as specifically approved by us and in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

13.2 You must not establish a link from any website that is not owned by you.

13.3 The Website or MU Parking Application must not be framed on any other website, and you must not create a link to any part of this Site other than the home page. We reserve the right to withdraw linking permission at any time without written notice.

14. GENERAL

14.1  If any of these Terms are held to be invalid, unenforceable or illegal for any reason, the remaining Terms will continue to apply.

14.2  These Terms are governed by the laws of Victoria, Australia. You agree to the jurisdiction of the courts of Victoria to determine any dispute arising out of these Terms.

14.3  All rights which are not expressly granted in these Terms are expressly reserved.

Monash University Parking Terms and Conditions

Please read the information below about parking at Monash University’s premises and using the Parking Permit system.

General

  • Monash University campuses are subject to the Victorian State traffic and parking laws, including but not limited to the Road Safety Act 1986 and Road Rules (Victoria)
  • Parking is in accordance with the Monash University Parking Rules.
  • Monash University reserves the right to cancel a driver’s parking permit in accordance with the Monash University Parking Rules.
  • The purchase of a parking permit does not guarantee the availability of a parking space.
  • PAYU permits are available for all permit bays across all Monash University Australian campuses.
  • PAYU permits must be applied for and paid for through the Monash University Parking Application known as “MU Parking” and which is provided by UbiPark or through the web portal in accordance with statutory requirements and the terms and conditions applicable to the use of the  MU Parking App and/or web portal.
  • Staff and students must register via Single Sign On (Okta) to be eligible for a parking permit. If a valid Monash account login is not provided, the driver will only be able to purchase a metered parking permit and the relevant metered parking rates will be charged. The driver will not be eligible for a refund in the event they later provide a valid Monash account login.
  • Retailers and contractors must register to validate their eligibility for applicable PAYU rates. A driver will not be eligible for a refund in the event they do not successfully register for PAYU parking rates.
  • PAYU permits are valid from the time a session is started through the MU Parking App. Failure to start a session may result in a parking infringement being issued.
  • It is the driver’s responsibility to select the ‘default’ vehicle parked on campus in the MU Parking App. Failure to have the correct vehicle active may result in a parking infringement being issued.
  • It is the driver’s responsibility to select the correct ‘zone’ in which they are parked on campus in the MU Parking App. The driver will not be eligible for a refund in the event they select the incorrect zone code.
  • It is the driver’s responsibility to stop their session in the MU Parking App when they finish parking if required. PAYU permit charges will be calculated based on the start and end times of the parking session as input into the MU Parking  App. The driver will not be eligible for a refund in the event they forget to stop their parking session.
  • PAYU parking permits will be charged daily to the nominated credit/debit card in the  MU Parking App, unless the user has chosen to salary sacrifice the payment. Salary sacrifice will be billed fortnightly via Monash payroll.
  • Payment against the relevant credit card will be processed by UbiPark when the parking session is ended with the exception of transactions under 50 cents. UbiPark will wait for these transactions to accumulate to over 50 cents minimum before the relevant amount is deducted from the credit card or via salary sacrifice.
  • The management of vehicles registered to an account is through the  MU Parking App and the web portal.
  • All refund requests for the parking sessions and eligible permits must be approved by the BPD Transport Administrator.
    • Credit Card payment refunds for staff and students will be reviewed and processed by BPD and will incur a processing fee.
    • Salary Sacrifice payment refunds for staff will be reviewed and approved by BPD Parking Administrators. Monash HR will perform any refunds manually on the next pay run after they have been approved
  • An email invoice will be sent after the end of each parking session.
  • 28-day permits must be applied for through the web portal.
  • 28-day permits are valid from the date selected when purchased
  • 28-day permits are valid for 28 consecutive days, including weekends and public holidays
  • Multiple vehicle registration numbers can be entered into the MU Parking App or web portal. It is the driver’s responsibility to select the ‘default’ vehicle which is parked on campus in the MU Parking App or web portal.
  • 28-day permits cannot be cancelled and no refunds will be issued for these permits.
  • 28-day permits must be opted into prior to the start of each 28-day period, they do not automatically renew
  • An email invoice will be sent after the purchase of a permit.
  • Annual Permits must be applied for online through the web portal.
  • Annual permits are valid from 1 January (Commencement Date) to 31 December of the relevant year. The permit cost is prorated from application date to 31 December of the relevant year
  • Multiple vehicle registration numbers can be entered into the MU Parking  App or web portal. It is the driver’s responsibility to select the ‘default’ vehicle which is parked on campus in the MU Parking App or web portal.
  • Where an annual permit is purchased using either a credit or debit card, and the permit is no longer required, the permit holder should cancel the permit in the r web portal and the refund request will be reviewed by Buildings and Property Division for processing. The refund amount is calculated from the date on which the permit is cancelled by the Buildings and Property Division and will be shown on the cancelled permit information in the web portal, less a $25 administration fee.
  • If the permit was paid via credit/debit card, the refund amount will be refunded back to the card. If the permit is salary sacrifice, there will be no further deductions from Payroll.
  • An email invoice will be sent after the purchase of a permit.

Pay as you use (PAYU) Parking Permits

  • PAYU permits are available for all permit bays across all Monash University Australian campuses.
  • PAYU permits must be applied for and paid for through the Monash University Parking Application known as “MU Parking” and which is provided by UbiPark or through the web portal in accordance with statutory requirements and the terms and conditions applicable to the use of the  MU Parking App and/or web portal.

28-day Permits

  • 28-day permits must be applied for through the web portal.
  • 28-day permits are valid from the date selected when purchased
  • 28-day permits are valid for 28 consecutive days, including weekends and public holidays
  • Multiple vehicle registration numbers can be entered into the MU Parking App or web portal. It is the driver’s responsibility to select the ‘default’ vehicle which is parked on campus in the MU Parking App or web portal.
  • 28-day permits cannot be cancelled and no refunds will be issued for these permits.
  • 28-day permits must be opted into prior to the start of each 28-day period, they do not automatically renew
  • An email invoice will be sent after the purchase of a permit.

Annual Permits

  • Annual Permits must be applied for online through the web portal.
  • Annual permits are valid from 1 January (Commencement Date) to 31 December of the relevant year. The permit cost is prorated from application date to 31 December of the relevant year
  • Multiple vehicle registration numbers can be entered into the MU Parking  App or web portal. It is the driver’s responsibility to select the ‘default’ vehicle which is parked on campus in the MU Parking App or web portal.
  • Where an annual permit is purchased using either a credit or debit card, and the permit is no longer required, the permit holder should cancel the permit in the r web portal and the refund request will be reviewed by Buildings and Property Division for processing. The refund amount is calculated from the date on which the permit is cancelled by the Buildings and Property Division and will be shown on the cancelled permit information in the web portal, less a $25 administration fee.
  • If the permit was paid via credit/debit card, the refund amount will be refunded back to the card. If the permit is salary sacrifice, there will be no further deductions from Payroll.
  • An email invoice will be sent after the purchase of a permit.

Refunds

Refunds will not be provided where the driver:

  • Selects the wrong zone code
  • Forgets to stop a parking session

Prebooking Parking sessions

Monash staff and students will be eligible to pre-book their PAYU parking sessions up to one week in advance. Prebooking of parking does not guarantee a parking space and is done at the staff/student’s risk.

Booking is confirmed once payment has been successfully processed. A confirmation email with details of the booking will be sent to the email address provided at the time of booking. The parking permit is valid only for the specified date(s) and time(s) as indicated in the booking confirmation and is non-transferable. Cancellations may be subject to a fee, and refunds may not be provided for cancellations made within a certain timeframe prior to the booked date.

The following applies only to Monash University Staff

Salary Sacrifice

  • Only staff who are continuing or fixed term are eligible to apply to salary sacrifice their parking payments. Please read the Salary Sacrifice Procedure to check your eligibility.
  • Staff need to access the parking permit system via the Single Sign On (OKTA) which will validate their Monash University account and check if they are eligible to salary sacrifice their parking.
  • Staff will be required to choose salary sacrifice as a payment method when paying for permits or PAYU parking.
  • The staff member must have sufficient earnings at the time of processing the salary sacrificing arrangement.
  • At the time of applying the salary sacrificed parking arrangement, if the staff member has terminated, moved to an unpaid leave arrangement, or changed employment classifications that excludes salary sacrificing, the University will not be able to complete the salary sacrificing arrangement.
  • There will be no administrative fee charged when a staff member elects to salary sacrifice their parking.
  • If an eligible staff member chooses to salary sacrifice their PAYU permit, they agree to  Monash University deducting their parking payment. This amount will be deducted before GST at each fortnight pay
  • Two deductions may occur after holiday periods due to the way fortnightly pays are remunerated at Easter and Christmas.
  • An annual Green /Chancellery permit is purchased using the web portal.
  • If an eligible staff member chooses the salary sacrifice option on their parking permit, they agree to Monash University deducting the amount in fortnightly payments until the permit is fully paid for, for that calendar year. This amount will be deducted before GST.
  • An email with a breakdown of parking deductions will be sent during a pay cycle where parking has occurred within the pay cycle’s previous 14-day period.
